El objetivo del presente artículo consiste en exponer el modo en el cual Lacan y Deleuze pueden contribuir a delinear una hipótesis sobre el estatuto de la afirmación. Pese a que tradicionalmente se ha tratado de mantener una separación estricta entre ambos pensamientos, mostraremos que existe la posibilidad de exponer una afirmación radicalizada, que pondría a ambos en la pista de un pluralismo abierto a las diferencias singulares no reducibles a una identidad dominante. En ambos casos, ello supondría una puesta (...) en entredicho y una reformulación de la negación. La lectura desarrollada por Lacan a partir del comentario hegeliano de la Verneinung, llevada a cabo por Jean Hyppolite, permite entender cómo la negatividad abre más bien cierto tipo de afirmación, que quizá anticipa la formulación de una ontología de la diferencia, como la que Deleuze advierte en Hyppolite contra Hegel. Intentaremos mostrar que dicha afirmación se produce conceptualmente al momento de elaborar cierta destitución del problema de la negatividad. En su mutuo refuerzo, advertiremos que se puede pensar una potencia de afirmación de la diferencia, apoyada en esta alianza entre una teoría elaborada desde preocupaciones clínicas y un pensamiento obstinado en sustraer a la diferencia de la negatividad. El concepto de la vida en Nietzsche es una idea central, tanto de su propio pensamiento como en relación a sus repercusiones en el debate contemporáneo. Sus múltiples significaciones superan el campo en el cual inicialmente había sido planteado, invitando a la discusión en las fronteras disciplinares y al debate interdisciplinario. Se plantea examinar la concepción nietzscheana del eterno retorno desde la noción lacaniana de repetición con tal de esclarecer la idea de la vida como mujer.

La oveja (Ovis aries) es el primer animal domesticado para consumo en un hito histórico que marca el inicio de la sedentarización de las comunidades humanas al comienzo del Neolítico. Durante milenios, fueron semejantes al muflón asiático (Ovis orientalis), su ancestro salvaje. Las razas primitivas supervivientes en el norte de Europa son oscuras, mudan el pelo estacionalmente, tienen cuernos en ambos sexos y apenas producen lana. Los ancestros de las modernas surgieron hace unos 3.500 años. Se seleccionaron para producir lana (...) blanca, que crece indefinidamente y se colecta anualmente. Este proceso coincide con la invención de las tijeras de esquilar y con el descubrimiento de tintes como la púrpura. Solo la lana blanca puede teñirse de cualquier color, permitiendo trasladar al tejido las mismas señales que quizá antes nos pintábamos con ocre sobre el cuerpo. La oveja, un herbívoro social muy manejable, sumaba al suministro de alimento el de una fibra abrigada y modificable en su color distintiva de quienes la visten. Un lienzo en blanco donde trasponer las expresiones estéticas antes restringidas al cuerpo, al arte rupestre y al mobiliar. De ahí que diversas mitologías contemplen una relación simbólica especial con ellas. La revolución estética propiciada por las ovejas blancas zozobra en el siglo XX con la aparición de nuevas fibras y el abaratamiento de otras. Hoy, los arquetípicos y blancos rebaños característicos de la iconografía occidental tienden a una coloración mixta al devaluarse la lana. Otras especies domésticas con fibras que solo recientemente se han apreciado comercialmente, como las cabras de angora (Capra hircus) o las llamas (Lama glama), siguen un proceso idéntico al emprendido con las ovejas hace milenios para tornarse blancas. Presentamos las implicaciones estéticas que han estimulado la selección artificial de ovejas con lanas blancas desde un punto de vista transdisciplinar. Siguiendo la corriente bioevolutiva, que entiende nuestra conducta estética y sus manifestaciones como parte de nuestra etología, veremos cómo ese largo proceso estuvo incentivado por nuestro deseo de teñir los tejidos para expresar un fenotipo extendido creando una nueva señal social. Esa nueva señalización, operante en el plano de la selección sexual, se va complicando al desarrollarse nuestras capacidades simbólicas y tecnológicas, siendo sintomática del entorno causal en el que se produce. This research uses a survey to analyze types of benefits sought by partners in cross-sector collaborations in Spain and to test and build upon theories that indicate prior collaboration experience and partner alignment will positively affect value creation through the collaboration. Using exploratory factor analysis to operationalize a broad range of potential benefits into more specific concepts, the results of this study identify distinct factors that characterize the types of benefits sought by non-profit organizations and businesses engaged in cross-sector collaborations. (...) Findings show that prior experience and alignment positively affect each factor for value creation. Prior experience is also found to influence the type of benefits sought from cross-sector collaborations and to positively affect alignment in terms of mission and strategy. Este ensayo es consecuencia de las reflexiones que desde hace años realizamos en el Instituto de Paz y Conflictos de la Universidad de Granada y que nos ha obligado a hacer una deconstrucción crítica de algunos aspectos del pensamiento pacifista. Bien es cierto que la supervivencia de la especie ha sido posible porque la respuesta a la conflictividad ha sido, mayoritariamente, la búsqueda de equilibrios dinámicos y de armonía. Pero, a pesar de todo, perviven muchas grietas, rupturas, dadas por la (...) propia contingencia y fragilidad humanas. Estamos ante unos entes humanos fragmentados, violentados, lo que hace más difícil la búsqueda de la armonía o la paz. Estas dificultades son razones de peso para trabajar en el camino de una «desfragmentación» ontológica que sea útil para liberar nuestras fuerzas emancipadoras y creativas. Construir la visión integrada y unitaria de la Ciencia de los Seres Humanos es una tarea conjunta que interesa sobremanera a la Investigación para la Paz.This essay is a consequence of the reflections we have been conducting for several years at the Instituto de Paz y Conflictos of the University of Granada. These reflections have obliged us to undertake a critical deconstruction of a few aspects of pacifist thought. Although the survival of the species has been possible because the response to conflicts has been, principally, the search for dynamic equilibrium and harmony; on the other hand there remain many fissures, ruptures brought about by the own human contingency and fragility. We find ourselves before a fragmented and distorted human being, which makes the search for harmony or peace even more difficult. These difficulties are convincing reasons for working towards an ontological “defragmentation” which is useful to liberate our emancipating and creative forces. To build the integrated and united view of Human Sciences is a collective task which is of great interest for Peace Research. (shrink)

El objetivo de la investigación es demostrar que la aplicación del Flipped Classroom mejora el nivel de logro del aprendizaje significativo en estudiantes universitarios. Para la recolección de datos en los grupos control y experimental se aplicaron dos instrumentos: el pre-test y el post-test. Concluido con la aplicación de los talleres basados en la metodología FC, en el postest se observó que en el grupo control, 26 estudiantes obtuvieron una calificación aprobatoria y 11 reprobatoria, mientras que en el grupo experimental, (...) 38 estudiantes, de acuerdo a los criterios de evaluación, todos lograron una calificación aprobatoria. In every case, what one sees is the self-directed processes of matter and energy interacting with the whim and will of human history itself to form a panoramic vision of the West free of rigid teleology and naive notions of progress, and even more important, free of any deterministic source of its urban, institutional, and technological forms. The variety of religious communities present in today’s western-European countries, and their subsequent political impact, urgently calls for a new model of articulation between church and state, religion and politics. This essay makes some suggestions for one such model based on Saint Augustine’s sermons and letters. In those writings, Augustine shows us the everyday political practices of his Christian community – practices based on which this article proposes a model where both the religious communities are entitled to be present in (...) the public arena, and the political authorities have the tools to assure peace and order. For that reason, revisiting Augustine’s work is crucial for a contemporary reflection on the relationship between state and church. Finally, this essay also systematizes the Augustinian distribution of political tasks between Monks, Christian laity, Christian magistrates, and Bishops. (shrink)

The paper gives an overview of primate research and the economic-ethical 'lessons' we can derive from it. In particular, it examines the complex, multi-faceted and partially conflicting nature of (non-) human primates. Our closest living relatives, the chimpanzees and bonobos, apparently walk on two legs: a selfish and a groupish leg. Given evolutionary continuity and gradualism between monkeys, apes and humans, human primates seem to be bipolar apes as well. They, too, tend to display a dual structure: there seems to (...) be a pro-social and a self-interested side to our species and a bipolar tension seems to exist between competition and cooperation respectively between self-interest and the common good. We are apparently at the same time Homines oeconomici and Homines culturali. Our inner ape tries to combine self-interested and common good motives. Based on de Waal's Russian doll model, the essay investigates the evolutionary origins of morality and 'eusociality'. With the help of selected case studies stemming from behavioural sciences/economics, the paper illustrates examples of empathy, altruism, reciprocal fairness, pro-social and other-regarding preferences, inequity aversion and altruistic punishment in (non-)human primates. Beside this selfless and groupish side, the paper also reflects on the self-interest and egoistic nature of (non-)human primates and the behavioural and cognitive differences between monkeys, apes and humans. Fundamentos teóricos y metodológicos presentes en Historia y estilo -- Historia y estilo, importancia para la teoría del arte en Cuba.

In this article Roland Sintos Coloma argues for the relevance of empire as an analytical category in educational research. He points out the silence in mainstream studies of education on the subject of empire, the various interpretive approaches to deploying empire as an analytic, and the importance of indigeneity in research on empire and education. Coloma examines three award-winning books, Lawrence Cremin's The Transformation of the School: Progressivism in American Education, 1876–1957, John Willinsky's Learning to Divide the World: (...) Education at Empire's End, and David Wallace Adams's Education for Extinction: American Indians and the Boarding School Experience, 1875–1928, in order to delineate the heuristic spectrum of the use of empire in educational research. These texts are put in conversation with the interdisciplinary fields of American, postcolonial, race/ethnic, and indigenous studies where questions of empire have received considerable attention. Ultimately, mobilizing empire as an analytical category will enable researchers, policymakers, and educators to establish new connections and dispute long-standing views about discursive, structural, and affective dynamics at local, national, and global levels. This book functions as a set of theoretical, empirical, and pedagogical challenges to two fields of scholarship.

Presupposition, vagueness, and oddness can lead to some sentences failing to have a clear truth value. The homogeneity property of plural predication with definite descriptions may also create truth-value gaps: The books are written in Dutch is true if all relevant books are in Dutch, false if none of them are, and neither true nor false if, say, half of the books are written in Dutch. We study the projection property of homogeneity by deploying methods of general interest to identify (...) truth-value gaps. Method A consists in collecting both truth judgments and, independently, falsity judgments. The second method, employed in experiment series B and C, is based on one-shot ternary judgments: completely true vs. completely false vs. neither. After a calibration of these methods, we use them to demonstrate that homogeneity projects out of negation, the scope of universal sentences and the scope of non-monotonic quantifiers such as exactly two, to some extent. We assess our results in light of different theoretical approaches to homogeneity—approaches based on presuppositions, scalar implicatures, and something like supervaluations, respectively. We identify free parameters in these theories and assess various variants of them based on our results. Our experimental paradigms may be of broader significance insofar as they can be applied to other phenomena which result in the failure of a sentence to have a definite truth value. (shrink)

This paper discusses the logical space of alternative conceptual engineering projects, with a specific focus on (1) the processes, (2) the targets and goals, and (3) the methods of such projects. We present an overview of how these three aspects interact in the contemporary literature and discuss those alternative projects that have yet to be explored based on our suggested typology. We show how choices about each element in a conceptual engineering project constrain the possibilities for the others, thereby giving (...) rise to distinct groupings of possible projects under the banner of conceptual engineering. We conclude with a critical reflection on the potential ethical issues that arise as a result of effectively putting conceptual engineering into practice. (shrink)

Conceptual engineering means to provide a method to assess and improve our concepts working as cognitive devices. But conceptual engineering still lacks an account of what concepts are (as cognitive devices) and of what engineering is (in the case of cognition). And without such prior understanding of its subject matter, or so it is claimed here, conceptual engineering is bound to remain useless, merely operating as a piecemeal approach, with no overall grip on its target domain. The purpose of this (...) programmatic paper is to overcome this knowledge gap by providing some guidelines for developing the theories of concepts and of cognition that will ground the systematic unified framework needed to effectively implement conceptual engineering as a widely applicable method for the cognitive optimization of our conceptual devices. Conceptual engineering is the method for assessing and improving our concepts. However, little has been written about how best to conceive of concepts for the purposes of conceptual engineering. In this paper, I aim to fill this foundational gap, proceeding in three main steps: First, I propose a methodological framework for evaluating the conduciveness of a given concept of concept for conceptual engineering. Then, I develop a typology that contrasts two competing concepts of concept that can be used in conceptual (...) engineering — namely, the philosophical and psychological ones. Finally, I evaluate these two concepts of concept using the proposed methodological framework and I show that, when it comes to making conceptual engineering an actionable method, the psychological concept of concept outclasses its philosophical counterpart on all counts. This provides a baseline from which the concept of concept can be further improved for the purposes of conceptual engineering. (shrink)

Our visual environment is highly predictable in terms of where and in which locations objects can be found. Based on visual experience, children extract rules about visual scene configurations, allowing them to generate scene knowledge. Similarly, children extract the linguistic rules from relatively predictable linguistic contexts. It has been proposed that the capacity of extracting rules from both domains might share some underlying cognitive mechanisms. In the present study, we investigated the link between language and scene knowledge development. To do (...) so, we assessed whether preschool children with Developmental Language Disorder, who present several difficulties in the linguistic domain, are equally attracted to object-scene inconsistencies in a visual free-viewing task in comparison with age-matched children with Typical Language Development. All children explored visual scenes containing semantic, syntactic, or both inconsistencies. Since scene knowledge interacts with image properties to guide gaze allocation during visual exploration from the early stages of development, we also included the objects’ saliency rank in the analysis. The results showed that children with DLD were less attracted to semantic and syntactic inconsistencies than children with TLD. In addition, saliency modulated syntactic effect only in the group of children with TLD. Our findings indicate that children with DLD do not activate scene knowledge to guide visual attention as efficiently as children with TLD, especially at the syntactic level, suggesting a link between scene knowledge and language development. El aumento de la complejidad sintáctica evidencia el desarrollo lingüístico de los niños. El uso de ciertas medidas de lenguaje permite dar cuenta de dicho proceso, lo que ha sido corroborado en niños preescolares hispanohablantes y en niños en etapas tardías de desarrollo. Este trabajo propone explorar dicho desarrollo contrastando a un grupo de niños chilenos con desarrollo típico que asisten a preescolar con un grupo de primer año básico. Las medidas incluyeron índices primarios y secundarios de complejidad y se (...) obtuvieron a partir de recontados narrativos producidos por los niños. En los resultados se observa que no todos los índices aumentan al contrastar los dos grupos. Solo aumenta un índice primario de densidad clausular dentro de las oraciones complejas y el número de subordinadas sustantivas, particularmente en las etapas narrativas de presentación y final; en paralelo, disminuye el número de subordinadas adverbiales en la fase de final. Estos resultados evidencian que, si bien se observa un aumento en algunas medidas de complejidad al contrastar los grupos, el desarrollo de estas habilidades no presenta un mismo patrón en todas las dimensiones, lo que puede deberse a factores discursivos o del propio proceso de desarrollo lingüístico. Plural definite descriptions across many languages display two well-known properties. First, they can give rise to so-called non-maximal readings, in the sense that they ‘allow for exceptions’. Second, while they tend to have a quasi-universal quantificational force in affirmative sentences, they tend to be interpreted existentially in the scope of negation. Building on previous works, we offer a theory in which sentences containing plural definite expressions trigger a family of possible interpretations, and where general principles of language use account for (...) their interpretation in various contexts and syntactic environments. Our theory solves a number of problems that these previous works encounter, and has broader empirical coverage in that it offers a precise analysis for sentences that display complex interactions between plural definites, quantifiers and bound variables, as well as for cases involving non-distributive predicates. The resulting proposal is briefly compared with an alternative proposal by Križ, which has similar coverage but is based on a very different architecture and sometimes makes subtly different predictions. William Molyneux was born in Dublin, studied in Trinity College Dublin, and was a founding member of the Dublin Philosophical Society (DPS), Ireland’s counterpart to the Royal Society in London. He was a central figure in the Irish intellectual milieu during the Early Modern period and – along with George Berkeley and Edmund Burke – is one of the best-known thinkers to have come out of that context and out of Irish thought more generally. In 1688, when Molyneux wrote the (...) letter to Locke in which he posed the now famous question about a man born blind made to see, he was an active member of the DPS and was on familiar terms with several other key figures in Irish philosophy at the time. For the most part, Irish thinkers in the seventeenth and eighteenth centuries answered “no” to Molyneux’s question of whether a blind man made to see could distinguish, by sight alone, between a cube and a sphere. Conceptual engineering is the method for assessing and improving our concepts. Some have recently claimed that the implementation of such method in the form of ameliorative projects is truth-driven and should thus be epistemically constrained, ultimately at least (Simion 2018; cf. Podosky 2018). This paper challenges that claim on the assumption of a social constructionist analysis of ideologies, and provides an alternative, pragmatic and cognitive framework for determining the legitimacy of ameliorative conceptual projects overall. The upshot is that one should (...) not ameliorate for the sake of truth or knowledge, in the case of ideologies—at least, not primarily. (shrink)

The debate surrounding ‘big tech’ and antitrust has dominated public policy discourses over the past few years in many parts of the world. Noteworthy is that several countries and regions, including China, the European Union, and the United States, have launched investigations into the allegedly anticompetitive and exclusionary business practices of companies such as Amazon, Apple, Facebook, and Google and their Chinese counterparts, Alibaba and Tencent. This paper builds on the renewed interest in the topic and discusses in detail – (...) and from an ordoliberal perspective – the key characteristics of the digital economy, the business conduct of tech platforms, and the corresponding antitrust concerns, as well as possible reform steps which could help to strengthen modern-day competition law and policy (and antitrust enforcement). On its ‘broad-spectrum’ version, it is expected to be appropriately applicable to any of our representation-involving cognitive activities, with major consequences for our whole cognitive life. This paper is about the theoretical foundations of conceptual engineering thus characterised. With a view to ensuring the actionability of conceptual engineering as a broad-spectrum method, it addresses the issue of how best to construe the subject matter of conceptual engineering and successively (...) defends the theses that conceptual engineering should be: (i) About concepts, (ii) psychologically theorised, (iii) as multiply realised functional kinds. Thereby, I claim to theoretically secure and justify the maximum scope, flexibility, and impact for the method of conceptual engineering on our representational devices in our whole cognitive life—in other words, a broad-spectrum version of conceptual engineering. The paper presents a renewed Habermasian view on transnational multi-stakeholder initiatives (MSIs) and assesses the institutional characteristics of the Equator Principles Association (EPA) from a deliberative democracy perspective. Habermas’ work has been widely adopted in the academic literature on the political responsibilities of (multinational) corporations (i.e., political corporate social responsibility), and also in assessing the democratic qualities of MSIs. Commentators, however, have noted that Habermas’ approach relies very much on ‘nation-state democracy’ and may not be applicable to democracy in MSIs—in (...) which nation-states are virtually absent. We argue that Habermas’ detailed conceptualization of the institutionalization of deliberative democracy can be applied to transnational MSIs if these initiatives can be said to have their own ‘dèmoi’ that can be represented in associational decision-making. Therefore, we develop a definition of the dèmos of an MSI based on the notion of collective agency. Subsequently, we explain how Habermas’ approach to democracy can be applied to MSIs and show that it has more to offer than hitherto has been uncovered. Our illustrative analysis of the EPA confirms the criticisms regarding this MSI which have recently been articulated by researchers and practitioners, but also yields new findings and possible avenues for the further development of the EPA: That is, although our assessment suggests that the EPA in its current state is still far from being a democratic MSI, the possibility of a sensible analysis of its democratic character indicates that transnational MSIs can, in principle, help to fill governance gaps in a democratic way. In the light of several ongoing antitrust investigations in the E.U. and the U.S., the following research paper analyzes whether ‘big tech’ – same as the big banks – need special regulatory (and economic -political) attention and if so, how an updated form of regulatory policy for the digital era could look like. It does so by utilizing – and reviving – the normative and business -ethical ideals of German ‘neoliberalism’, also known as (classical) ordoliberalism. Especially, Walter Eucken’s work has (...) the potential to inform and enrich the current debate concerning the regulation of big tech. The main goal of the paper is to outline a potentially new regulatory framework – one that combines (and revises) Eucken’s ordoliberalism with the competition policy of the European Union. (shrink)

Firms engage in corporate social responsibility (CSR) because they consider that some kind of competitive advantage accrues to them. We contend that resource-based perspectives (RBP) are useful to understand why firms engage in CSR activities and disclosure. From a resource-based perspective CSR is seen as providing internal or external benefits, or both. Investments in socially responsible activities may have internal benefits by helping a firm to develop new resources and capabilities which are related namely to know-how and corporate culture. In (...) effect, investing in social responsibility activities and disclosure has important consequences on the creation or depletion of fundamental intangible resources, namely those associated with employees. The external benefits of CSR are related to its effect on corporate reputation. Corporate reputation can be understood as a fundamental intangible resource which can be created or depleted as a consequence of the decisions to engage or not in social responsibility activities and disclosure. Firms with good social responsibility reputation may improve relations with external actors. They may also attract better employees or increase current employees’ motivation, morale, commitment and loyalty to the firm. This article contributes to the understanding of why CSR may be seen as having strategic value for firms and how RBP can be used in such endeavour. (shrink)

The past few years have seen the opening of several antitrust investigations against some of the most dominant and powerful companies in the world—e.g., the U.S. Department of Justice, numerous states, and the Federal Trade Commission have sued Google, Facebook, and Amazon, and the E.U. has launched additional proceedings against Amazon, Apple, Facebook, and Google. This paper looks at the latest trends and developments in the E.U. and the USA and analyzes the different regulatory approaches taken from a distinct business (...) ethics, that is, ordoliberal perspective. The paper aims to derive ordoliberal-inspired antitrust principles and apply them to the current antitrust proceedings and investigations, thereby assessing their strengths and weaknesses. It also aims at developing ordoliberal-inspired reform proposals which might help to strengthen and “harden” modern-day antitrust regimes. (shrink)

With a view to ensuring the actionability of conceptual engineering as a broad‐spectrum method, it addresses the issue of how best to construe the subject matter of conceptual engineering and successively (...) defends the theses that conceptual engineering should be: (i) About concepts, (ii) psychologically theorised, (iii) as multiply realised functional kinds. Thereby, I claim to theoretically secure and justify the maximum scope, flexibility, and impact for the method of conceptual engineering on our representational devices in our whole cognitive life—in other words, a broad‐spectrum version of conceptual engineering. Understanding what motivates employees is essential to the success of organizational objectives. Therefore, properly capturing and explaining the full range of such motivations are important. However, the classical and most popular theories describing employee motives have neglected, if not omitted entirely, the importance of the ethical and spiritual dimensions of motivation. This has led to a model of a person as self-interested, amoral, and non-spiritual. In this paper, we attempt to expose this omission and offer a more complete taxonomy of (...) motivations which include these dimensions. Although more work will need to be done to fully develop the ethical and spiritual dimensions of motivation, the expanded taxonomy will provide the foundations and serve as a guide for such further research. Furthermore, this new categorization of motivations brings out the full dimensions of being human, which promises to lead to improved management practices with regard to employees and foster greater human flourishing in the workplace. ABSTRACTThis article studies multi-stakeholder initiatives as spaces for both deliberation and contestation between constituencies with competing discourses and disputed values, beliefs, and preferences. We review different theoretical perspectives on MSIs, which see them mainly as spaces to find solutions to market problems, as spaces of conflict and bargaining, or as spaces of consensus. In contrast, we build on a contestatory deliberative perspective, which gives equal value to both contestation and consensus. We identify four types of internal contestation which can be (...) present in MSIs—procedural, inclusiveness, epistemic, and ultimate-goal—and argue that embracing contestation and engaging in ongoing revision of provisional agreements, criteria, and goals can enhance the democratic quality of MSIs. Finally, we explore the implications of this perspective for theorizing about the democratic quality in MSIs and about the role of corporations in transnational governance. (shrink)

Economics students and economists have—grosso modo—a bad societal reputation. This is, roughly speaking, the provocative result of the majority of empirical studies on economic education. On average, economists and economics students behave in a more self-interested way than others; they are more prone to deviate from the moral good; they tend to free-ride more often and invest less in public goods games; they are more corrupt and less honest in lost letterexperiments, less cooperative in solidarity games, and accept less and (...) keep more in ultimatum bargaining games. In short: they seem to behave more in accordance with the predictions of the rational or self-interest model of standard economics, the Homo oeconomicus model. What might be the reasons that the degree of anti-social and uncooperative behavior is on average significantly more pronounced among economics students compared to other student groups? Can these empirical findings be explained by the self-selection effect and/or the indoctrination effect? What are the implications of these empirical results for economic ethics and economic education? Which roles do the economics curriculum and economic textbooks play? Do they have any effect on everyday behavior? Is the way economics is taught at (business) schools, colleges and universities co-responsible for the considerable behavioral differences? And what can be done in order to reverse these trends and to foster other-regarding preferences and pro-social behavior? The paper analyzes these and other questions with the help of experimental economics, behavioral economics and neuroeconomics. It also draws on recent findings of brain physiology research in general and neuroplasticity in particular. (shrink)

La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. This paper reports on a study of the largest Spanish corporations concerning the status of corporate ethics policies. The research project, the first of its kind in Spain, has two parts. First, the types of formal documents the companies use are analysed, including those dealing with ethical values or norms. Three groups of companies are distinguished: the first group has no formal documents dealing with ethical values, and the reasons given for not having any ethical statement are discussed. A second (...) group has one document mentioning ethical values (generally the vision and/or mission statement), and a third group has in place two or more documents (one generic and the other more detailed, such as a code of conduct). The findings show that the latter group is more proactive than the former in implementing measures for promoting business ethics throughout the organisation. In the second part of the research, the study analyses the differences between companies whose headquarters are in Spain, Europe and USA regarding the arguments, the focus and the practices used to formalise business ethics.
